Whatever is not specifically regulated by the present contract of carriage and by Articles 1737-1741 of this year, is subject to the General Terms as observed by Italian Forwarding Agents for international consignments, published in the Official Gazette No.66, dated 10/3/1975, updated text 7/9/92. It is understood that the undertaking on our part to directly execute all or part of the transport – in accordance with and for the purposes of Article 1741 of the Civil Code – depends on our specific acceptance in writing. Lacking that, we only undertake to conclude a contract in the name and on behalf of the customer, as well as to carry out the accessory operations.
Our responsibility for the commitments entrusted to us does not exceed what is laid down in the regulations and conditions of such transport companies as the Railways, Shipping etc.. Claims against us will have no validity if the receiver has not held the last carrier responsible. We are not answerable for errors arising from misunderstandings during phone calls. No insurance – whether sea, land or any other kind – is provided without a formal order in writing on each separate occasion. In the event of litigation the parties concerned come under the jurisdiction of the Trieste Law Courts.
Quotations are based on current tariffs and exchange rates, and are subject to change without notice. Conditions of payment: all fees payable in advance, except where there is a different agreement in writing. Freight, Customs duties and Port charges: payable in advance.

In default of payment within the terms agreed upon, interest will be owed as provided for by legislative decree 231/2002, which interest will start solely following a formal placing in default sent by registered letter with returned receipt in express derogation of Art. 4 – 1 comma of the decree cited. |
